Today people around the world woke up to the news that Prop 8 has been overturned in California. This is a great step forward for Gay and Lesbian Rights, and one step forward in the hopes of equal rights in Marriage for all! Yahoo News report "The 9th Circuit Court in California struck down as unconstitutional the state's voter-passed ban on gay marriage Tuesday, ruling 2-1 that it violates the rights of gay Californians." The positive article on Yahoo News was followed by many negative user comments expressing their frustration. The users feel that the vote to ban gay marriage was won with a majority basis and should not be overturned. However the debate continues as the constitution clearly states that the majority should not determine the fate of the minority therefore Prop 8 should have never been on any ballot. Judge Stephen Reinhardt writes "Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and Lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," The pro-Prop. 8 camp has said it will appeal the decision and access to Gay Marriage will remain on hold during the appeals process, however the excitement shown online by the Gay and Lesbian community is overwhelming.
